Terms, Conditions & Privacy Policy

1. Definitions

“Company” refers to Nessie Interior Design.
“Client” refers to the individual or entity purchasing services.
“Services” refers to all virtual interior design services provided by the Company.

2. Scope of Services

2.1 The Company provides virtual interior design services, including concept designs, mood boards, layouts, and product recommendations.
2.2 All services are delivered digitally unless otherwise agreed in writing.
2.3 The Client acknowledges that all designs are conceptual and intended as guidance for implementation.

3. Fees and Payment

3.1 All fees are quoted in South African Rand (ZAR).
3.2 Full payment is required prior to commencement of Services unless otherwise agreed.
3.3 The Company reserves the right to withhold delivery of any design work until full payment has been received.
3.4 Prices are subject to change without prior notice; confirmed bookings will not be affected.

4. Client Obligations

4.1 The Client agrees to provide accurate and complete information, including measurements, photographs, and preferences.
4.2 The Company shall not be held liable for errors resulting from inaccurate or incomplete information supplied by the Client.
4.3 The Client is responsible for verifying all measurements prior to implementation.

5. Design Process and Timelines

5.1 The design process begins once all required information and payment have been received.
5.2 Estimated turnaround time is 4–6 weeks, depending on the scope of work.
5.3 The Company is not liable for delays caused by incomplete client information or delayed responses.

6. Revisions and Variations

6.1 Revisions are limited to those included in the selected package.
6.2 Additional revisions may incur additional charges.
6.3 Significant changes to the original brief may be treated as a new project.

7. Product Recommendations

7.1 Recommendations are made based on availability at the time of design.
7.2 The Company does not guarantee stock availability, pricing, or supplier performance.
7.3 The Client is responsible for purchasing and sourcing all recommended items.

8. Implementation and Third Parties

8.1 The Client is responsible for all aspects of implementation, including contractors and installation.
8.2 The Company is not liable for third-party workmanship, delays, or damages arising from implementation.

9. Cancellations and Refunds

9.1 Due to the customised nature of the Services, payments are non-refundable once work has commenced.
9.2 Cancellation prior to commencement may be considered at the Company’s discretion and may be subject to an administrative fee.

10. Limitation of Liability

10.1 The Company shall not be liable for any indirect, incidental, or consequential damages.
10.2 Total liability shall not exceed the total fees paid by the Client.

11. Intellectual Property

11.1 All designs and materials remain the intellectual property of the Company.
11.2 The Client is granted a non-transferable license for personal use only.
11.3 Designs may not be copied, distributed, or used commercially without written consent.

12. Confidentiality

Both parties agree to keep confidential any sensitive or proprietary information shared during the project.

13. Governing Law

These Terms shall be governed by the laws of the Republic of South Africa, and any disputes shall be subject to its jurisdiction.

14. Privacy Policy (POPIA Compliance)

14.1 The Company is committed to protecting personal information in accordance with the Protection of Personal Information Act, 4 of 2013 (POPIA).

 

14.2 The Company may collect:

  • Name and surname

  • Contact details (email and phone number)

  • Address and location details

  • Room measurements, photos, and design preferences

  • Any other information voluntarily provided

 

14.3 Personal information is collected to:

  • Deliver design services

  • Communicate with the Client

  • Create customised designs

  • Process payments and invoices

  • Improve service offerings

 

14.4 Consent

By engaging the Company’s services, the Client consents to the collection and processing of their personal information for the purposes outlined.

14.5 Storage and Security

The Company takes reasonable technical and organisational measures to protect personal information from unauthorised access, loss, or misuse.

14.6 Sharing of Information

Personal information will not be sold or shared without consent, except where necessary to deliver services (e.g. payment providers).

14.7 Client Rights

The Client has the right to:

  • Access their personal information

  • Request correction or deletion

  • Withdraw consent (subject to legal obligations)

Requests may be submitted via email.

14.8 Retention of Information

Information will only be retained for as long as necessary or as required by law.

15. Acceptance
